Case Narrative
DSI was appointed as a Chapter 11 Trustee of this group of debtors that owned and operated IP of A West Oaks Mall, an enclosed regional shopping mall in the Western suburbs of Houston, Texas. The approximately 1.1 million square foot mall includes five anchor sites along with 500,000 inline mall space for national and local retailers.
As part of the Chapter 11, the Trustee and DSI participated in the negotiation for use of cash collateral with the lender, undertaken a solicitation process to sell the mall and prepared a plan of reorganization to address the complex capital structure of the debtors, lenders and other contractual obligations of parcel lease interest holders, tenants and general trade creditors. Ultimately, the debtors’ plan was confirmed and the property was sold.
