Case Narrative
A DSI professional was appointed Trustee for Namco Capital Group when it and its owner were forced into Chapter 11 bankruptcy. Namco was a real estate investment concern through which $3 billion flowed between 2003 and 2008. Most of these and other funds were diverted by Namco’s owner for his and his family’s benefit through a labyrinthine structure comprised of more than 400 entities. In unraveling this structure and investigating the debtor’s financial affairs, the Trustee also discovered that Namco’s funds were used to purchase all manner of vacant and developed real property during the real estate boom, apparently all without any proper due diligence or feasibility studies. The Trustee has evaluated the estate’s interest in various business entities and real estate holdings, negotiated ownership settlements in favor of the estate and sold numerous vacant and developed land holdings. In addition, the Trustee has resolved over 200 lawsuits to recover diverted funds, including from Namco’s owner and his family members.
