Case Narrative
Nursing South Corporation is a home health agency that provides in home services to clients based upon orders issued by the client’s doctors. The Owner of the business became incapacitated and is a Ward in a guardian proceeding and there was a dispute with the Ward’s Son who had stepped in to run Nursing South but then left as were outstanding issues between the parties to the Guardianship proceeding that remained, including ownership of Nursing South.
An emergency motion was filed by the Plenary Guardian wherein it stated that it was imperative that the Court appoint a corporate monitor to continue operating Nursing South and save the business from going under until the parties settle the outstanding issues.
