Case Narrative

Upon the Chapter 11 filing by the borrower immediately upon DSI’s appointment as Receiver, DSI’s role and responsibilities for this 1,443 stall, fully operational dairy facility included negotiating a new lease agreement with better economic terms for the secured lender, ensuring that the dairy herd was well maintained, that feed stocks were sufficient to carry the herd through the winter and working with the borrower and IDEM on a manure management plan and lagoon remediation to address issues of concern raised by IDEM.  The debtor successfully exited Chapter 11 with the support of the secured lender and unsecured creditors and was in compliance with all regulatory agencies operating requirements.
